Montana GOP Bylaws Blocked by Judge After Lawsuit

A Montana judge has temporarily blocked new rules adopted by the Montana Republican Party after a group of Republicans filed a lawsuit arguing that the changes give party leaders too much power.

A Lewis and Clark County District Court judge issued a temporary restraining order on July 8, stopping the Montana GOP from enforcing its new 2026 bylaws while the court reviews the case.

Republicans Challenge New Montana Party Rules in Court

The lawsuit was filed by the Yellowstone and Chouteau County Republican Central Committees, along with several Republican officials and members, including Rep. Brad Barker and former Montana GOP Chairman Jeff Essmann.

At the center of the lawsuit is a question that has created plenty of debate within the party: Who gets to decide what it means to be a Republican?

The new bylaws include rules regarding party membership, support for Republican principles, and restrictions on working with Democrats or supporting Democratic candidates. Party leaders say the changes are meant to protect the identity and values of the Republican Party.

Debate Over Who Controls Montana Republican Party Membership

Critics, however, argue the rules could give party officials the ability to remove elected Republicans from the party, even after voters chose them in a primary election.

The lawsuit comes after almost a year of internal conflict within the Montana GOP, including disagreements over nine Republican lawmakers, known as the "Nasty Nine," who worked with Democrats during the 2025 legislative session.

A hearing is scheduled for July 13, where the court will decide whether the bylaws will remain blocked or be allowed to take effect.
